Three Killed in Tragic Head-On Collision and Pedestrian Accident in Susanville

Susanville, CA (January 30, 2025) – A devastating series of accidents on Highway 395 south of the Bass Hill landfill claimed the lives of Kelly Ann Erwin, 46, of Susanville, Raymond Edward White, 67, of Janesville, and Steven Ray Bresolin, 52, of Susanville.

Accident Details: The incident occurred around 5:40 a.m. when Erwin, driving a Dodge Durango southbound on Highway 395, attempted to pass a semi-truck. As she passed, her vehicle collided head-on with a northbound Toyota 4-Runner driven by White. Both drivers were killed instantly. Moments after the collision, Bresolin, who had stopped his vehicle on the shoulder to assist, was struck and killed by another northbound vehicle while on foot. The driver of that vehicle remained on the scene, called 911, and cooperated with authorities. The California Highway Patrol is handling the investigation.

Legal Considerations: As a personal injury attorney, I find that this tragedy raises legal questions regarding liability and the duty of care owed by drivers. Key considerations include:

  • Driver Responsibility and Passing Safety: Investigators will examine whether Erwin acted negligently by attempting to pass the semi-truck under unsafe conditions. California law requires drivers to ensure the road ahead is clear before overtaking another vehicle. Failure to do so can constitute negligence, potentially contributing to the fatal outcome.
  • Pedestrian Safety: Bresolin’s death while trying to render aid highlights the dangers of being on foot near active traffic. The driver who struck Bresolin is cooperating with the investigation, and police will assess whether they were speeding, distracted, or otherwise negligent.
  • Other Factors: Investigators will also consider whether the highway design, lighting, or signage influenced the collisions. If hazardous road conditions contributed to the accident, the government agency responsible for maintaining Highway 395 may share liability. Investigators will also look at the mechanical function of all vehicles involved.

The families of the victims may pursue wrongful death claims if evidence reveals negligence by any party involved. California’s comparative negligence laws may be implicated if any of the parties are found negligent. Note that their families may still be able to recover partial compensation, reduced by their portion of negligence.

I extend my deepest condolences to the families and loved ones of Kelly Ann Erwin, Raymond Edward White, and Steven Ray Bresolin. I hope the ongoing investigation provides clarity.
