Zachary Gilfillan Suffers Major Injuries in Electric Unicycle Collision

Napa, CA (July 30, 2024) – On Thursday, Zachary Gilfillan, 28, sustained major injuries in a collision while riding his electric unicycle on the shoulder of Cuttings Wharf Road in the Carneros area, according to the California Highway Patrol (CHP).

Accident Details: The incident occurred around 8 p.m. north of Las Amigas Road. Gilfillan was struck by an unknown vehicle while riding his Ninebot unicycle. The impact caused Gilfillan, who was not wearing a helmet, to lose control of his unicycle, resulting in the device overturning. Despite the severity of his injuries, they were deemed non-life-threatening. He was transported to Providence Queen of the Valley Medical Center for treatment.

Investigation: Though nearby residents came to Gilfillan’s aid, there were no direct witnesses to the collision. The CHP is actively seeking information about the vehicle involved in the incident. Anyone with details is encouraged to contact the CHP’s Napa office.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Identifying the driver of the vehicle that struck Gilfillan is paramount. Leaving the scene of an accident violates California law and suggests a lack of care for human life. Also, given that the unicycle was overturned, it is worth investigating whether there was any mechanical failure or defect in the Ninebot unicycle. If a defect is found, there could be grounds for a product liability claim against the manufacturer.

While Gilfillan was not wearing a helmet, which may have contributed to the severity of his injuries, California law does not mandate helmet use for electric unicycles. This factor may influence the case, potentially raising issues of comparative negligence, but it would not absolve other parties of responsibility.

Depending on the outcome of the investigation, Gilfillan’s family may be able to file a wrongful death claim.

My sincerest condolences are with the family and friends of Zachary Gilfillan during this difficult time.
