Tragic Train Accident Claims Life of Kenneth Ray Foster on Rosedale Highway in Bakersfield

Bakersfield, CA (June 17, 2024) – In the early morning of June 17, 2024, a tragic accident occurred on the Rosedale Highway overpass in Bakersfield, resulting in the death of 77-year-old Kenneth Ray Foster.

Accident Details: According to the Kern County Coroner’s Office, Foster was struck by a train and sadly pronounced dead at the scene. The investigation is still ongoing.

Legal Considerations: As a personal injury lawyer, I find that several factors warrant further consideration. ailway companies have a duty of care to ensure the safety of pedestrians and to operate their trains in a manner that minimizes the risk of accidents. This duty extends to maintaining proper warning systems, ensuring the visibility of trains, and adhering to speed limits. In this case, it will be crucial to investigate whether the Burlington Northern and Santa Fe Railway fulfilled its obligations. It is also important to consider the surrounding environment. Factors such as poor lighting, unclear signage, or potential obstacles that could impair a pedestrian’s ability to avoid oncoming trains must be taken into account. Investigating whether Foster might have had difficulty seeing the approaching train or hearing its warning signals will help piece together a more comprehensive picture of the incident. Depending on the findings of the investigation, Foster’s family may be able to file a wrongful death claim.

My deepest condolences go to the family and friends of Kenneth Ray Foster during this heartbreaking time.
