Santa Cruz County, CA (October 17, 2024) – On Thursday night, a deadly crash occurred on Highway 9 in the Santa Cruz Mountains, resulting in the death of 36-year-old Stephen David Bass, a resident of Boulder Creek.
Accident Details: The crash occurred around 10:17 p.m. when a California State Parks Ranger attempted to pull over Bass, who was driving a black 2014 Mazda 3. Instead of stopping, Bass fled, leading to a brief pursuit. The Mazda veered off the road during the chase and crashed into a tree. Unfortunately, Bass was not wearing a seatbelt at the time of the accident and sustained fatal injuries. He was pronounced dead at the scene. While the exact cause of the crash is still under investigation, officials of the California Highway Patrol believe that alcohol may have played a role in the incident.
Legal Considerations: As a personal injury attorney, I find that the circumstances surrounding the crash raise several legal issues. Investigators will examine Bass’s actions:
- Failure to Obey Law Enforcement: The driver’s decision to evade the police initiated a dangerous situation, contributing to the crash.
- Alcohol Involvement: If alcohol consumption is confirmed, it could indicate negligence. Driving under the influence breaches the duty of care drivers owe to others on the road, making the driver liable for the resulting harm.
- Seatbelt Non-Usage: The lack of a seatbelt may influence potential liability, injury severity, and the legal analysis of damages.
However, even if investigators determine Bass was negligent, they still must determine other external reasons he lost control of the vehicle.
- Vehicle Malfunction: They will likely examine the Mazda and look for mechanical malfunctions or defects that could have caused Bass to lose control. If found, the vehicle manufacturer or service provider may be liable.
- Road Conditions: The conditions of the road will be scrutinized. If investigators determine the existence of road defects, inadequate signage, or an improperly designed road, the local municipality may share liability.
Possible Claims: If other parties are found liable, Bass’s family may be able to file a wrongful death claim and recover compensation for their loss. However, their compensation will be reduced based on Bass’s share of fault under California’s comparative negligence laws.
My deepest condolences go out to the family and friends of Stephen David Bass during this difficult time.
