Fatal Rollover Crash on Interstate 15 in Wildomar Kills Juan Carlos Poblete and One Other

Wildomar, CA (May 27, 2024) – In the early hours of Monday, May 27, a tragic accident occurred on Interstate 15 in Wildomar, resulting in the deaths of Juan Carlos Poblete, 22, and his 39-year-old passenger.

Accident Facts: According to the California Highway Patrol (CHP), Poblete was driving a 1999 GMC Savanna van south on the I-15, north of Leomon Street. The van suddenly veered towards the shoulder. The car struck a metal guardrail before it overturned. Paramedics from the Riverside County Fire Department pronounced both Poblete and his passenger dead at the scene.

Investigation: The severity of the crash was exacerbated by the fact that neither Poblete nor his passenger were wearing safety belts, which led to their ejection from the vehicle. The CHP has indicated that alcohol is suspected to have played a role in the collision, pending confirmation from the autopsy reports. As a personal injury attorney, I find that several aspects of this case require examination.

Alcohol Involvement: Given the CHP’s suspicion that alcohol was a factor, determining Poblete’s blood alcohol concentration (BAC) through the autopsy will be crucial.

Vehicle Maintenance and Defects: Investigating the mechanical condition of the 1999 GMC Savanna van could uncover whether any vehicle defects or maintenance issues contributed to the crash. This includes checking for brake failure, steering issues, or other mechanical faults that may have caused or worsened the accident.

Seat Belt Usage: Understanding why the seat belts were not used—whether due to a malfunction or personal choice—can influence the assessment of liability.

Comparative Negligence: Even if Poblete is found to have been under the influence or that the failure to wear their seatbelts was a personal choice, the families of the victims may still be able to recover for the negligence of other negligent parties because of California’s comparative negligence laws. However, the damages recoverable in their wrongful death claim may be decreased.

My sincerest condolences to the family and friends of Juan Carlos Poblete and the other deceased during this difficult time.
