Fairfield, CA (February 5, 2025) – Authorities have identified Robert McPherson, 63, as the victim of a fatal motorcycle crash that occurred Wednesday night in Fairfield.
Accident Details: The collision happened around 8:05 p.m. near the entrance of a Circle K gas station at the intersection of First and West Texas streets. McPherson was riding his motorcycle along West Texas Street when a vehicle struck him, ejecting him from his motorcycle. The driver, a 68-year-old man, had been attempting to turn left into the gas station. McPherson was pronounced dead at the scene.
Investigation: Police reported that the driver remained at the scene and cooperated with the investigation. The crash remains under investigation. Drugs and alcohol are not believed to have been factors.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination.
- Right-of-Way and Traffic Violations: Turning left across oncoming traffic requires drivers to yield the right-of-way to other vehicles. Investigators will examine whether the driver failed to yield or misjudged the distance and speed of McPherson’s motorcycle. Both could be considered negligence under California law.
- Road Conditions: Road conditions will be analyzed to determine whether they contributed to the crash. The municipality may be liable if road defects, poor design, or improper signage contributed to the crash.
McPherson’s family may consider pursuing a wrongful death lawsuit if evidence shows the negligence caused the crash. Compensation could address funeral expenses, loss of companionship, and other damages.
I extend my deepest condolences to Robert McPherson’s family and loved ones during this challenging time. I hope the investigation provides clarity and closure for those affected.
