Pedestrian Gudelia Aviles De Jaime Killed in Livingston Crosswalk Accident

Livingston, CA (January 12, 2025) – A tragic pedestrian accident in Livingston claimed the life of 72-year-old Gudelia Aviles De Jaime on the afternoon of January 12, 2025.

Accident Details: The collision occurred just before 4:30 PM in the area of North Main and Davis Streets. Aviles De Jaime was walking inside a crosswalk when she was struck by a Honda Pilot making a left turn onto North Main Street. The driver of the Honda, who is believed to be a 56-year-old woman, remained at the scene and cooperated with authorities. Sadly, Aviles De Jaime was pronounced dead at the scene. Police have indicated that neither drugs nor alcohol appear to be a factor in the collision.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Pedestrians have the right-of-way in marked crosswalks. Drivers are legally obligated to yield to pedestrians and ensure their safety before crossing an intersection. Failing to yield to a pedestrian in a crosswalk is generally a violation of traffic laws and can demonstrate negligence on the driver’s part. To be thorough, investigators should also consider other contributing factors, such as visibility obstructions, poor road conditions, and mechanical malfunctions.

Potential Wrongful Death Claim: If another’s negligence is found to be the cause of the accident, Aviles De Jaime’s family may have grounds to file a wrongful death lawsuit. This claim seeks to compensate the family for their losses, including funeral expenses, loss of financial support, and loss of companionship.

My deepest condolences go out to the family and friends of Gudelia Aviles De Jaime during this challenging time.
