Monterey County, CA (August 22, 2024) – On Thursday morning, a tragic incident occurred on Nashua Road near Monte Road, resulting in the death of Maximina Solano-Sabino, a 23-year-old woman from Gilroy.
Accident Details: Solano-Sabino, was crossing the road when she was struck by a Chevy Suburban traveling westbound. The Suburban, which had two occupants, collided with Solano-Sabino. The driver of the vehicle immediately pulled over and cooperated with authorities. CHP confirmed that DUI was not a factor in the crash.
Sadly, Solano-Sabino was pronounced dead at the scene by responding authorities.
Legal Considerations: As a personal injury attorney, I find that several factors require careful investigation to determine potential liability. Although DUI was not involved, questions remain regarding the circumstances leading up to the accident. Key aspects to consider include:
- Visibility and Road Conditions: What were the visibility and road conditions at the time of the incident? Poor lighting, road design, or weather conditions could have contributed to the driver’s inability to see the pedestrian in time.
- Driver Attention and Speed: Was the driver maintaining appropriate attention to the road and adhering to the speed limit? Even if DUI is ruled out, other forms of negligence, such as distracted driving or speeding, could play a role.
- Pedestrian Behavior: Was the pedestrian crossing at a designated crosswalk, and were there any traffic control devices, such as lights or signs, at the location? Understanding the actions of the pedestrian is also crucial in determining liability.
If negligence is found on the part of the driver or other parties, the family of Maximina Solano-Sabino may have grounds to pursue a wrongful death claim. This type of claim can help the family seek compensation for their profound loss, covering funeral expenses, lost income, and other damages related to the tragedy.
My deepest condolences go out to the family and friends of Maximina Solano-Sabino during this incredibly difficult time. Losing a loved one so suddenly is a profound tragedy, and my thoughts are with those affected.
