Pedestrian David Beard Killed in Turlock Collision

Turlock, CA (December 2, 2024) – David Beard, a 63-year-old Turlock resident, tragically lost his life on the evening of Monday, December 2, 2024, after being struck by a vehicle at the intersection of Golden State Boulevard and Golf Road. 

Accident Details: The California Highway Patrol (CHP) received a report at approximately 7:36 p.m. and discovered Beard lying in the roadway. He was transported to Doctors Medical Center in Modesto, where he succumbed to his injuries. According to the preliminary investigation, Beard reportedly ran eastward from the west shoulder directly into the path of a 2021 Chevrolet pickup truck traveling northbound on Golden State Boulevard. The driver, identified as 44-year-old Duraye Kinhoo, also a Turlock resident, remained at the scene and cooperated fully with authorities. Kinhoo, who was wearing a seatbelt at the time of the collision, was determined not to be under the influence of alcohol or drugs.  

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Pedestrian accidents often raise complex legal questions, particularly when determining liability. 

  • Driver Behavior: California law requires drivers to exercise caution, especially in areas where pedestrians may be present. Investigators will assess the circumstances, such as whether the driver had sufficient time to react, was speeding, or was distracted. If evidence suggests negligence on the driver’s part, Kinhoo may be deemed liable.
  • Mechanical Malfunction: Investigators will also examine the condition of the Chevrolet to determine if a mechanical function contributed to the accident.
  • Road Conditions: Golden State Boulevard should also be examined to see if any defects caused the accident. Also, they should see if there were proper pedestrian safety measures.

Depending on the findings of the investigation, Beard’s family may be able to file a wrongful death claim and recover compensation for their loss, including funeral expenses, loss of financial support, and emotional distress. Investigators may find that Beard was partially at fault for the accident when he attempted to cross the street. However, this would not necessarily prohibit his family from recovering compensation for his death. The compensation would be reduced based on his portion of the fault.
