Pedestrian Cristero Peter Luna Killed in Oxnard Collision

Oxnard, CA (December 22, 2024) – On the evening of Sunday, December 22, 2023, a pedestrian, 58-year-old Cristero Peter Luna of Oxnard, was struck by a vehicle at the intersection of Gonzales Road and Williams Drive.

Accident Details: A 25-year-old driver in a 2004 Toyota Camry struck Luna while traveling west on Gonzales Road. Luna was transported to Ventura County Medical Center in critical condition. He succumbed to his injuries the following day. Police have stated that neither drugs nor alcohol appear to have been factors in the incident, and the driver remained at the scene and has not been cited or charged.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination.

  • Driver’s Potential Liability: Investigators will examine whether the driver exercised reasonable care when turning onto Gonzales Road. This investigation includes evaluating speed, attentiveness, and adherence to traffic laws.
  • Pedestrian’s Actions: Authorities may also investigate Luna’s actions. Questions about where he was crossing and whether he was in a marked crosswalk or an area designated for pedestrian traffic could influence liability assessments.
  • Intersection Safety: The intersection itself may be scrutinized. If the intersection’s design or inadequate safety measures contributed to the collision, the city or another governmental entity could be held responsible for the unsafe road conditions.

Depending on the investigation’s findings, Luna’s family may have grounds to file a wrongful death claim. Compensation could address funeral costs, emotional distress, and loss of companionship.

My sincerest condolences are with the family and friends of Cristero Peter Luna during this difficult time.
