Newport Beach, CA (July 3, 2024) – On Tuesday afternoon, July 2, 2024, Patricia McKay, a 68-year-old visitor from New Zealand, was tragically killed after being run over during an attempted armed robbery at the Fashion Island Mall in Newport Beach.
Accident Details and Investigation: According to Newport Beach Police, two suspects, one armed with a handgun, approached a couple, initiating a struggle that led to McKay being dragged into a parking lot. The suspects then retreated to a white Toyota Camry driven by a third accomplice. During their escape, one of the suspects fired several shots, fortunately missing everyone, but the vehicle ran over McKay, resulting in her death at the scene. Her husband was not seriously injured. The suspects were apprehended after a high-speed chase on the 405 Freeway. They have been booked on suspicion of murder, armed robbery, and conspiracy.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Understanding all the factors involved can help ensure that those responsible are held accountable. In addition to the criminal liability the suspects face, Patricia McKay’s family may pursue a wrongful death lawsuit against the suspects. There may also be liability on the part of the mall or its security services. If there were lapses or failures in the security measures that could have prevented this tragic event, there might be grounds for additional claims.
My sincerest condolences are with the family and friends of Patricia McKay during this challenging time.
