Stockton, CA (July 27, 2024) – On the evening of Saturday, July 27, a tragic accident occurred on southbound Highway 99, south of Wilson Way, in Stockton, California, resulting in the death of 56-year-old John Skipper of San Leandro.
Accident Details: According to the California Highway Patrol (CHP), the crash happened at approximately 8:34 p.m. when Skipper, riding his motorcycle at 80 mph, lost control while braking after changing lanes. The motorcycle collided with the back of another vehicle, leading to Mr. Skipper’s fatal injuries. The CHP reported that alcohol is believed to have been a factor in the crash. Fortunately, no other injuries were reported.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination.
Skipper’s Conduct: The CHP’s preliminary report suggests that alcohol may have been a factor in the crash. A thorough investigation into Skipper’s blood alcohol content (BAC) at the time of the accident is crucial. It will also be imperative to determine whether speed was a significant contributing factor and understand why Skipper was traveling at that speed.
California is a comparative negligence state. So even if these two factors amount to negligence on Skipper’s part, his family may still be able to file a wrongful death claim if another party’s negligence also contributed to the crash.
Third-Party Liability: It is essential to investigate the state of the motorcycle and the other vehicle involved. This investigation includes checking for mechanical failures or defects that could have contributed to the accident. For example, did a braking issue cause Skipper to travel at such high speeds, or did a defect impair his ability to stop? Additionally, examining the road conditions at the time of the crash, such as lighting, signage, and any potential hazards, can provide insight into external factors that may have played a role. These two examples of negligence may implicate the liability of the vehicle manufacturer or the local municipality.
My deepest condolences are with John Skipper’s family and friends during this heartbreaking and challenging time. I hope they find the support they need.
