Imperial Beach, CA (August 1, 2024) – A tragic motorcycle crash at the intersection of 13th Street and Donax Avenue in Imperial Beach claimed the life of 24-year-old Petty Officer Second Class Maximillian “Max” Herr.
Accident Details: Herr, a service member assigned to the Maritime Expeditionary Security Group 1 based in Imperial Beach, was struck by a pick-up truck around 8:30 a.m., according to the San Diego County Sheriff’s Department. Deputies responding to the scene confirmed that Herr died at the scene of the accident. The pick-up truck driver remained at the location and cooperated with the authorities.
Investigation: This intersection has been a concern for residents for years, with multiple accidents occurring there since at least 2011. A resident who witnessed the accident expressed hope that officials might consider installing a four-way stop sign to prevent future tragedies.
Legal Considerations: As a personal injury attorney, I find that a thorough investigation is essential to determine liability. Questions that need to be addressed include whether the intersection was appropriately controlled for traffic, whether the pick-up truck’s driver was adhering to traffic laws, and whether any external factors, such as road design or visibility issues, contributed to the collision.
The frequency of accidents at this intersection raises concerns about potential hazards that local authorities may have overlooked. If the intersection’s design or lack of traffic control measures is found to have contributed to the crash, the responsible governmental entity in charge of the intersection may be liable.
If negligence is found to have caused the accident, Maximillian HeHerr’samily may be able to file a wrongful death lawsuit and recover compensation for their loss.
I offer my deepest condolences to Maximillian HeHerr’samily and friends during this devastating time.
