La Palma, CA (December 18, 2024) – A tragic crash during a police pursuit claimed the life of 67-year-old Marianne Mildred Casey of La Palma on Wednesday.
Accident Details: The incident occurred when Anthony Hanzal, 43, allegedly fleeing from law enforcement after a grocery store theft, collided with Casey’s blue BMW. The pursuit began in Fullerton around 12:30 p.m. following a reported theft at an Albertsons store near N. Gilbert Street and W. Malvern Avenue. Officers attempted to stop Hanzal, but he refused, leading a chase onto the westbound 91 Freeway.
Hanzal caused a non-injury crash near Brookhurst Road and Orangethorpe Avenue during the pursuit. Shortly after he fled from that scene, the crash that killed Casey occurred. Hanzal has been booked on charges including petty theft, hit-and-run, and felony evading. He may face additional charges pending further investigation by the Orange County Sheriff’s Department.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Hanzal’s decision to evade police at high speeds demonstrated reckless behavior, which usually constitutes negligence under California law. His actions breached his duty to drive safely and endangered law enforcement and innocent motorists like Casey.
If Hanzal’s negligence is proven, Casey’s family may have grounds to pursue a wrongful death claim in addition to any criminal charges. This civil action could address their emotional and financial losses, including burial costs, loss of companionship, and other damages caused by Casey’s untimely death.
I extend my condolences to Marianne Mildred Casey’s family and friends during this heartbreaking time.
