San Benito, TX (April 19, 2025) – A 70-year-old man was killed Saturday afternoon in a two-vehicle crash involving a semi-trailer on FM 1421, and authorities say the truck driver was texting at the time of the collision, according to the Texas Department of Public Safety (DPS).
Accident Details: The crash occurred around noon at the intersection of FM 1421 and Road 233. DPS reports that Lorenzo Guajardo, a San Benito resident, was driving a blue Chevrolet Aveo southbound on FM 1421 and was attempting to make a left turn onto Road 233 when he was rear-ended by a red Kenworth semi-truck.
The truck, driven by Luis Fernando Gonzalez Altamirano, 39, of Mexico, failed to control its speed and slammed into the Aveo. Guajardo was transported to a nearby hospital, where he later died from his injuries.
Legal Considerations: During their preliminary investigation, DPS determined that Altamirano was texting while driving at the time of the crash. He was arrested and charged with criminally negligent homicide and booked into the Carrizalez Rucker Detention Center, where he is awaiting arraignment.
In cases involving distracted driving that leads to a fatality, both criminal and civil consequences may follow. The family of Lorenzo Guajardo may pursue a wrongful death claim in addition to the criminal charges already filed.
Ongoing Investigation: DPS continues to investigate the crash. Authorities have not stated whether any additional charges may be filed or if further details about the collision will be released.
