Fresno County, CA (July 31, 2024) –A tragedy struck Fresno County when 25-year-old Kaiden Bailey was fatally struck by a vehicle near the intersection of Fowler and Perrin, just outside Clovis.
Accident Details: A Toyota Sienna traveling south on Fowler Avenue struck Bailey, who was standing in the middle of the road. The Sienna was traveling 45 miles per hour. The accident occurred around 11:30 p.m., and the driver stopped and cooperated with authorities following the collision.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination to determine the cause of this tragic accident.
Road Conditions and Design: Bailey’s mother, Cathie Bailey, highlighted concerns about the road’s design and visibility. The narrowness of Fowler Road and its lack of adequate lighting at night could be significant factors. A thorough investigation into whether the road meets safety standards and whether the local government has addressed previous complaints or accidents could be crucial. If the road conditions contributed to the accident, there might be grounds for claims against local government entities responsible for road maintenance and safety.
Driver’s Responsibility: The driver who struck Bailey stopped and cooperated with the investigation, which is a critical aspect of the case. However, it is important to investigate whether the driver was adhering to the speed limit and whether any additional factors such as impaired driving or distractions played a role.
Civil Suit for Wrongful Death: Kaiden Bailey’s family may consider a wrongful death suit to seek compensation for their loss. This claim involves proving that the negligence of the driver or the inadequacies in road safety directly contributed to the fatal accident.
My sincerest condolences are with the family and friends of Kaiden Bailey during this difficult time.
