Orcutt, CA (September 23, 2024) – On Monday, a devastating head-on collision on Highway 135 at East Foster Road in Orcutt tragically claimed the life of 79-year-old Sharlene Marie Plunkett, a resident of Santa Maria.
Accident Details: The crash occurred just before noon. The California Highway Patrol (CHP) reported that 26-year-old Jordan Gutierrez, also of Santa Maria, was traveling northbound in his Nissan when his vehicle veered into oncoming traffic, crossing into the southbound lanes. His car collided head-on with Plunkett’s Honda. Both victims were rushed to Marian Regional Medical Center. Sadly, despite efforts to save her, Plunkett died shortly after arriving at the hospital. Gutierrez suffered major injuries.
The investigation into the cause of the accident is ongoing.
Legal Considerations: As a personal injury attorney, I find that a thorough investigation is required to determine what caused Gutierrez’s vehicle to drift into oncoming traffic. Was impairment or speeding involved? Was there a mechanical defect in his Nissan? Were there hazardous road conditions?
Wrongful Death Claim: Sharlene Plunkett’s family may have grounds for a wrongful death claim against the responsible party. Plunkett’s family could pursue compensation for funeral expenses, loss of companionship, and other damages associated with their profound loss. The investigation will need to clarify the exact cause of the crash before any legal steps are taken
Personal Injury Claim: Jordan Gutierrez, who suffered major injuries, may also have a potential personal injury claim depending on the party responsible for the crash.
My deepest sympathies go out to the family and friends of Sharlene Marie Plunkett as they navigate this heartbreaking time. I wish Jordan Guiterrez a fast recovery.
