Rosemead, CA (January 10, 2025) – A 60-year-old man, Frank Cherry, was tragically struck and killed by a vehicle while walking on an on-ramp to the San Bernardino (10) Freeway in Rosemead on Friday morning, January 10, 2025.
Accident Details: The incident occurred at approximately 6:35 a.m. on the northbound Rosemead Boulevard on-ramp to the westbound freeway. The pedestrian, later identified by the Los Angeles County Medical Examiner as Cherry, died at the scene.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. All drivers have the legal responsibility to drive safely to prevent any accidents. Pedestrians are generally given the right of way, and drivers must be vigilant. If the investigation finds that the driver was distracted, impaired, speeding, or violating other traffic laws, they could be found negligent.
If the driver is found to have acted negligently, Cherry’s family may be able to file a wrongful death claim. Possible compensation may include funeral expenses, loss of financial support, and emotional distress. However, Cherry was walking on the freeway on-ramps. This fact can complicate liability. Even if Cherry is found partially responsible for the accident, his family may still be able to recover compensation reduced by Cherry’s portion of the fault.
I offer my heartfelt condolences to the family and loved ones of Frank Cherry during this difficult time.
