Francisco Chay-Garcia Killed in La Habra DUI Crash

La Habra, CA (October 4, 2024) – A 23-year-old man, Rumualdo Ajxup Chay, was charged on Tuesday, October 8, with gross vehicular manslaughter while intoxicated after a tragic crash that killed 31-year-old Francisco Chay-Garcia standing in a garage in La Habra.

Accident Details: The incident occurred on the evening of Friday, October 4, around 10 p.m., in the 200 block of West First Avenue. Rumualdo Ajxup Chay crashed his vehicle into the garage. The collision caused the car to break through the back wall of the garage, killing Francisco Chay-Garcia.

Investigation and Criminal Charges: Rumualdo Ajxup Chay is accused of driving under the influence and faces a sentencing enhancement for fleeing the scene after the fatal crash.

Civil Liability: As a personal injury attorney, I find that several aspects of this case warrant further examination. In addition to the criminal charges Rumualdo Ajxup Chay faces, he may face civil consequences if the investigation finds that his negligence was the cause of the accident.

Negligence and Wrongful Death: Driving under the influence generally constitutes negligence. When someone chooses to drive while impaired, they breach their duty to drive safely. Francisco Chay-Garcia’s family may have grounds to bring a wrongful death claim against Chay. In a wrongful death case, the victim’s family could seek compensation for funeral expenses, loss of companionship, and other financial hardships stemming from the sudden death.

I extend my deepest condolences to the family and loved ones of Francisco Chay-Garcia during this incredibly difficult time. Losing someone in such a sudden and tragic manner is devastating, and I hope that those impacted find strength and support as they cope with this loss.
