Clearlake Oaks, CA (December 24, 2024) – On December 24, 2024, Frances Novak, 76, of Clearlake Oaks, tragically lost her life in a collision on Highway 53 in Lake County.
Accident Details: According to the California Highway Patrol (CHP), the crash occurred at approximately 6:26 a.m. near the intersection of Highway 53 and Highway 20. Investigators report that Novak was driving a Lexus RX3 SUV southbound on Highway 53 when she attempted a U-turn from the shoulder. The maneuver brought her vehicle directly into the path of an oncoming Peterbilt semi-truck. The truck struck the side of the SUV, causing a devastating impact. Novak was pronounced dead at the scene. The driver of the semi-truck was uninjured and remained at the crash site to cooperate with authorities. CHP-Clear Lake is continuing to investigate the collision, including whether drugs or alcohol were contributing factors.
Legal Considerations: As a personal injury attorney, I find that several factors must be examined to determine liability:
- Visibility and Timing: Did the SUV driver have a clear line of sight to execute the U-turn safely, and was the semi-truck driver given adequate time to react?
- Road Conditions: Were there any factors that might have contributed to the crash, such as poor lighting or defective road conditions?
- Speed and Action of the Truck Driver: Was the semi-truck driver adhering to speed limits and paying attention to the roadway?
- Driver Fitness: The investigation will also include standard evaluations to rule out impairment or other conditions that may have influenced either driver’s actions.
Depending on the outcome of the investigation, Novak’s family may be able to pursue a wrongful death claim. This claim could allow them to recover funeral expenses, loss of financial support, and emotional distress.
I extend my heartfelt condolences to Frances Novak’s loved ones during this difficult time.
