Fatal Scooter Accident in San Jose Kills Esias Amaru Ramos-Berhane

San Jose, CA (August 6, 2024) – On Tuesday, August 6, 2024, tragedy struck in South San Jose when an 11-year-old boy, Esias Amaru Ramos-Berhane, was hit and killed by a pickup truck.

Accident Details: The accident occurred around 4:30 p.m. on Camden Avenue near the Cambrian Park neighborhood. According to the San Jose Police Department, Ramos-Berhane was crossing the street on his scooter when he was hit by a Chevy pickup truck.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. While the driver had a green light, this does not automatically absolve them of liability. Pedestrian safety laws and crosswalk regulations must be reviewed. Even with a green light, a driver may still be found negligent if they fail to exercise reasonable caution. Conditions on Camden Avenue, such as visibility issues or road signage, will also be evaluated to see if they contributed to the accident.

The condition of the driver’s vehicle, including its braking and safety systems, may be reviewed to rule out mechanical failures that could have played a role in the collision.

Should negligence be established, the family of Esias Ramos-Berhane may have grounds for a wrongful death claim. This type of claim seeks to hold the responsible parties accountable and may cover medical expenses, funeral costs, and loss of companionship.

My sincerest condolences are with the family and friends of Esias Amaru Ramos-Berhane during this difficult time.
