Camarillo, CA (August 21, 2024) – On the morning of August 21, 2024, a tragic motorcycle accident on northbound Highway 101 resulted in the death of 25-year-old Miguel Banales of Oxnard.
Accident Details: According to the CHP, the crash occurred around six in the morning on Highway 101, south of Springville Drive in Camarillo. Banales was riding his Kawasaki Ninja motorcycle northbound. Banales veered off the roadway and onto the dirt shoulder. He then crashed through a chain-link fence and continued onto a private frontage road. The motorcycle flipped, and Banales was ejected. The reason Banales lost control of the motorcycle is still under investigation,
First responders arrived to find Banales unresponsive at the scene. He was transported by ambulance to Ventura County Medical Center, where he was later pronounced dead.
Legal Considerations: As a personal injury attorney, I find that several areas may warrant investigation. Did hazardous road conditions or environmental factors contribute to the crash? If poor maintenance or dangerous conditions played a role, there could be grounds for holding the responsible municipality liable. If a defect or mechanical failure contributed to the accident, the manufacturer or a maintenance provider may be liable for the wrongful death.
Banales’s family members may have the right to pursue a wrongful death claim. The goal of a wrongful death claim is to ensure that the family receives the financial support they need after such a devastating loss and to hold negligent parties accountable for their actions.
My deepest condolences go out to Miguel Banales’s family and friends during this challenging time. My thoughts are with those who knew and cared for him.
