Shasta County, CA (July 11, 2024) – Two individuals lost their lives, and one was injured in a tragic accident early Thursday morning on Highway 273, south of Happy Valley Road.
Accident Details: Stephen Jesse, a 36-year-old from Redding, was driving a Toyota Corolla northbound at high speed when, for reasons still under investigation, the vehicle swerved off the road to the east and collided with a metal light pole at the Happy Valley Road intersection. The impact caused the vehicle to come to rest in the intersection, blocking the northbound lanes of Highway 273. Jesse was transported to Mercy Medical Hospital, where he later succumbed to his injuries. One passenger, Michael Allen Harvey, a 56-year-old from Redding, was pronounced dead at the scene. The other passenger, identified as 35-year-old Daniel Bishop, sustained a broken left leg and was also transported to Mercy Medical for treatment.
Investigation: None of the occupants were reportedly wearing seatbelts at the time of the crash. The investigation into the exact cause of the accident is ongoing, and authorities are urging anyone with information to contact the investigating officer.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination, such as the following:
- Speed and Other External Factors: One critical aspect is the driver’s excessive speed and whether any external factors contributed to the vehicle leaving the roadway. Investigators will likely assess road conditions, visibility, and potential mechanical failures that may have influenced the driver’s actions. Additionally, the collision with a metal light pole and the resulting blockage of the intersection raises questions about road safety. Investigators will need to examine the presence of proper signage, lighting, and road design. If deficiencies are found, there could be grounds for a claim against the responsible government entity.
- Possible Claims: Depending on the investigation results, the families of Jesse and Harvey may be able to file wrongful death claims. Bishop may be able to file a personal injury claim.
- Comparative Negligence Laws: It is significant that none of the occupants were wearing seatbelts. California law mandates seatbelt use for all passengers, and failure to comply can affect determinations of negligence and liability. However, this potential liability would not negate financial recovery by the victims if another party also shares some responsibility. But California’s comparative negligence laws may be implicated. This could impact potential claims for damages by the victims or their families.
My sincerest condolences are with the family and friends of Stephen Jesse and Michael Allen Harvey during this difficult time. I wish Daniel Bishop a speedy recovery.
