Modesto, CA (October 16, 2024) – The California Highway Patrol (CHP) is investigating a deadly crash that occurred on Wednesday afternoon in the Modesto area that killed one woman and injured two individuals.
Accident Details: At approximately 3 p.m., first responders were called to a collision on SR-132, east of Crabtree Road. Initial reports from CHP suggest that a woman driving a 2001 Toyota sedan was heading east on SR-132 when she lost control on a curve, causing the car to spin and cross into the oncoming lane. The sedan collided with a westbound 1995 Toyota pickup driven by Billy Stilley, with Jason Crum as his passenger.
The driver in the Toyota was transported to Memorial Medical Center, where she later died from her injuries. Her name has not yet been released to the public. Stilley and Crum were treated for minor injuries at the same hospital. Authorities noted that all individuals involved were wearing seatbelts during the crash.
Legal Considerations: As a personal injury attorney, I find that the investigation into the crash will focus on several factors, including the reasons behind the sedan driver’s loss of control. Investigators will examine road conditions, potential mechanical failures, and other contributing factors.
Possible Claims: If it is determined that negligence was involved, depending on the facts, the deceased woman’s family may have grounds to file a wrongful death lawsuit. Stilley and Crum may be able to file personal injury claims.
Contributory Negligence: If the Toytota driver is found to have contributed to the accident by crossing into the adjacent lane, note her family may still be able to recover partial compensation if other parties were also negligent. California’s comparative negligence laws allow victims to recover compensation for their injuries caused by another’s negligence, even if they were partially negligent.
My heartfelt condolences go out to the family and friends of the woman who lost her life in this tragic incident. I wish Billy Stilley and Jason Crum a fast recovery.
