Phelan, CA (September 16, 2024) – A tragic hit-and-run accident in Phelan on Monday night claimed the life of 65-year-old Cynthia Moss.
Accident Details: The incident occurred around 7:45 p.m. at the intersection of Phelan and Buttemere Roads. Moss, who was using a walker to cross the street, was fatally struck by an eastbound vehicle believed to be a white Kia Sportage. The driver was traveling at an unknown speed. Authorities reported that the driver briefly pulled over to the south shoulder, untangled the walker from the front of the damaged vehicle, discarded it, and fled. Despite the efforts of first responders, Moss was pronounced dead at the scene.
Investigation: The vehicle involved likely sustained significant damage to the right side of its front end, but no description of the driver is available now. The CHP urges anyone with information about the incident to contact their Victorville Station.
Legal Considerations: As a personal injury attorney, I find that authorities must closely examine all available evidence, including any security camera footage from nearby businesses or residences and witness statements, to identify the vehicle and driver. A hit-and-run is particularly egregious because it reflects a failure to drive safely and stop after an accident. Fleeing the scene of an accident is a severe crime with both criminal and civil consequences.
Depending on the investigation’s outcome, the family of Cynthia Moss may have grounds to pursue a wrongful death claim. California law allows victims’ families to seek compensation for damages, such as funeral expenses, lost financial support, loss of companionship, and emotional distress.
I extend my deepest sympathies to the family and friends of Cynthia Moss during this difficult time.
