Palmdale, CA (July 27, 2024) – In the early hours of Saturday morning, a tragic two-vehicle crash on Avenue P east of 15th Street East in Palmdale resulted in the death of 34-year-old Darrica Wannamaker.
Accident Details: The accident, reported by the California Highway Patrol (CHP), occurred around 2:30 a.m. and involved a Toyota Camry driven by 21-year-old Adrian Lopez Garcia and a Kia Spectra driven by Wannamaker. Preliminary investigations by the CHP suggest that alcohol and drugs may have played a role in the crash.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Garcia’s suspicion of alcohol or drug use necessitates a thorough toxicology report. If impairment is confirmed, Garcia could face significant legal repercussions, including criminal and civil charges. Poor road conditions at the time of the crash and inadequate maintenance of both vehicles can shift some liability to the local municipality or vehicle manufacturer.
Wannamaker’s failure to wear a seat belt will be a factor in the case. California law mandates seat belt use, and while this may not absolve Garcia of responsibility, it could implicate California’s comparative negligence laws.
