Encinitas, CA (October 8, 2025) – A child was hospitalized and a driver was arrested on suspicion of DUI after a truck slammed into Gelato 101 on South Coast Highway 101, according to the San Diego County Sheriff’s Office, via 10News.
Accident Details: Around 6 p.m., a northbound Chevrolet Silverado rear-ended a 2022 Toyota Prius at South Coast Highway 101 and D Street, sending the truck into the gelato shop. A child seated inside the business was struck and trapped beneath the vehicle. First responders freed the child, who was conscious and breathing, and transported them to Rady Children’s Hospital for further treatment. The Prius occupants were evaluated at the scene and did not appear to be injured.
Investigation: Deputies identified the Silverado driver as 64-year-old Edward De La Torre, who was transported for treatment and subsequently arrested on suspicion of DUI. Investigators will analyze vehicle damage, collect witness statements, and review nearby cameras to determine precise speeds, impact angles, and contributing factors. The truck will remain inside the business until a structural engineer assesses the building’s integrity.
Legal Considerations: Crashes involving suspected DUI and a commercial setting can involve criminal charges along with civil claims for medical treatment, emotional distress, and property loss. Evidence such as surveillance video, medical records, and repair estimates can be vital to establishing liability and damages.
This was a terrifying incident for the child, family, and patrons. I wish the injured child a full and swift recovery.
