Escalon, CA (April 13, 2024) – A tragic incident on Highway 120 near Steinegul Road claimed the life of 20-year-old Anthony Ferreiro. The accident happened at around 8:39 p.m. on Saturday, when Ferreiro was struck by an eastbound 2010 Subaru Forester.
Incident Overview: According to authorities from the California Highway Patrol, a Subaru Forester, driven by a 42-year-old woman from Oakdale and traveling east at speeds estimated between 50 to 55 mph, struck Ferreiro. The collision occurred under dark conditions without street lighting, complicating visibility. Ferreiro, who was standing in the eastbound lane, was hit directly by the front of the Subaru. The impact threw him onto the windshield and then onto the highway’s south shoulder, where he succumbed to his injuries despite immediate CPR efforts.
Investigation and Legal Implications: Based on the information provided by CHP, it is clear that visibility in this particular spot of the road was poor. There were no streetlights in this area, compromising pedestrian safety. Given the circumstances, a couple of factors will influence the potential legal outcomes:
- Negligence and Duty of Care. The primary question is whether the driver exercised appropriate caution, especially considering the lack of street lighting and the pedestrian’s presence on the roadway.
- Municipal Liability: The darkness and absence of street lighting at the crash site might be considered contributing factors, possibly affecting the liability of municipal entities for inadequate road safety measures. If poor road lighting contributed to the accident, there could be grounds for a wrongful death claim against local government entities responsible for road maintenance and safety.
Given the complexities of this case, the family would benefit from consulting with an experienced personal injury attorney to explore all viable legal avenues for compensation.
I offer my sincerest condolences to Ferreiro’s friends and family following this accident. Losing a loved one in a potentially preventable accident is tragic. I hope that they receive support during this challenging time.
