Pedestrian Fatality on Etiwanda Avenue Claims Life of Luis Antonio Chavez

Ontario, CA (July 4, 2024) – On July 4, 2024, in Ontario, a tragic incident claimed the life of 34-year-old Luis Antonio Chavez of Anaheim.

Accident Details and Investigation: At approximately 3:39 a.m., officers from the Ontario Police Department responded to a report of a vehicle striking a pedestrian near the intersection of Etiwanda Avenue and 4th Street. Tragically, Mr. Chavez was pronounced deceased at the scene. The Ontario Police Department is currently investigating the incident to determine the circumstances surrounding the collision.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. First, it is crucial to determine whether the driver was negligent, which includes examining if the driver was distracted, speeding, under the influence of alcohol or drugs, or violating any traffic laws at the time of the incident. Additionally, the visibility and condition of the road at the time of the accident must be evaluated. Poor lighting, inadequate signage, or road hazards can contribute to such accidents and may implicate municipal liability if these factors are found to be deficient. If negligence is found, then Chavez’s family may be able to file a wrongful death claim. Another aspect to consider is the conduct of Mr. Chavez. Was he crossing the street legally and within a crosswalk? Pedestrians also have a duty to follow traffic laws. A deviation from this duty won’t negate the negligence of other parties, but it could implicate California’s comparative negligence laws.

My sincerest condolences are with the family and friends of Luis Antonio Chavez during this heartbreaking time.
