Guadalupe Chavez Killed in Pedestrian Accident on SR 1

Moss Landing, CA (April 14, 2024) – A fatal accident occurred on Highway 1 south of Portero Road late Sunday evening, resulting in the death of a pedestrian. Guadalupe Chavez, 41, of Castroville was identified as the victim.

Incident Overview: The accident took place at approximately 10:53 p.m. when the vehicle collided with Chavez as she walked in the southbound lane. She was struck by a blue 2012 Hyundai driven by a 42-year-old man from Aptos, who was unharmed and has not been arrested.

Investigation and Analysis: In this incident, several legal factors could affect the potential claims arising from the accident, including:

  1. Negligence. The primary legal consideration would be whether the driver was negligent, which depends on whether he failed to exercise reasonable care under the circumstances. Factors such as speed, distraction, or violation of traffic laws could be relevant.
  2. Visibility. Since the accident occurred at night, authorities are likely to examine what the lighting conditions were at the time of the collision. This is important in determining whether it was possible for the driver to see the pedestrian.

Based on preliminary information, the family of Guadalupe Chavez might pursue a wrongful death claim, potentially seeking damages for loss of companionship, emotional distress, and funeral expenses. Of course, if you have any information about the accident, please contact the CHP at 831-770-8000.

I offer my sincerest condolences to the family and friends of Guadalupe Chavez at this difficult time. I hope that they receive the support they need in the aftermath of this tragedy.
