San Bernardino, CA (June 8, 2024) – On Saturday, June 8, a tragic bicycle accident claimed the life of 43-year-old Nancy Carolina Ortiz in the night hours.
Accident Details: At approximately 10:35 PM, officers from the San Bernardino Police Department responded to a call reporting a bicyclist struck by a vehicle near the intersection of 30th Street and F Street. Ortiz was transported to St. Bernardine Medical Center, where she unfortunately died.
Investigation: The circumstances leading up to the accident remain unclear. The San Bernardino Police Department is conducting a thorough investigation.
Legal Considerations: As a personal injury lawyer, I find that several facts warrant examination. It is crucial to investigate whether the driver was under the influence of alcohol or drugs, distracted, or fatigued at the time of the accident. Any history of reckless driving or previous violations should also be reviewed. If so, the driver may be liable for negligence. Examining the lighting conditions and whether Ortiz had appropriate reflective gear or lighting on her bicycle can help determine if lack of visibility played a role in the accident. Additionally, the street lighting and visibility of traffic signs at the intersection are essential factors to consider. The design and condition of the road where the accident occurred need to be assessed. Were there any potholes, debris, or other hazards that could have caused the driver to lose control or fail to see the bicyclist? If negligence caused the accident, Ortiz’s family may be able to file a wrongful death claim against the negligent party.
My condolences to the family and friends of Nancy Carolina Ortiz during this heartbreaking and difficult time.
