Sacramento, CA (June 10, 2024) – On Monday night, in south Sacramento, a 36-year-old bicyclist, Jose Valladolid Ramirez, was fatally hit by a vehicle on Fruitridge Road.
Accident Details: The Sacramento Police Department received the call at around 10:30 p.m., Ramirez was found unresponsive and he was pronounced dead at the scene. Sacramento Police Department spokesperson, Officer Anthony Gamble, reported that officers had determined the driver involved in the crash was under the influence of drugs. The driver is expected to face charges related to drug possession and driving under the influence once medically cleared. The investigation into the crash remains ongoing.
Legal Considerations: As a personal injury attorney, I see several critical legal questions that demand a thorough investigation. Given that the driver was found to be under the influence of drugs, it’s imperative to examine the extent of the impairment and its direct contribution to the accident. The driver’s medical and toxicology reports will be crucial in establishing the level of intoxication and the specific substances involved. This information can significantly impact the determination of liability. If negligence is found, the family of Ramirez may be able to file a wrongful death claim. If successful, they would be entitled to various forms of compensation, such as medical expenses, funeral costs, loss of future income, and pain and suffering.
My deepest condolences are with the family and friends of Ramirez. I hope further investigation can reveal the cause of the accident.
