Hemet, CA (December 5, 2024) – A tragic crash occurred on Thursday morning in Hemet, claiming the life of 40-year-old Derek Holt.
Accident Details: The incident occurred around 8 a.m. on Acacia Avenue near Kirby Street. A suspect, identified as 27-year-old Noah Anthony Zapata of Menifee, was driving westbound on Acacia Avenue. Zapata, allegedly under the influence, collided with Holt’s municipal vehicle. Holt, who was working for the Hemet Department of Public Works, was pronounced dead at the scene.
Following the collision, Zapata was detained by CHP officers after an investigation suggested that he was driving under the influence. He was later booked on suspicion of DUI, resulting in great bodily injury. The investigation into the crash is ongoing.
Legal Considerations: As a personal injury attorney, I find that this heartbreaking incident raises serious questions about liability in DUI-related crashes. Driving under the influence is considered negligent because it significantly impairs a driver’s ability to operate a vehicle safely. By choosing to drive while intoxicated, the driver disregards their responsibility to avoid causing harm to others.
If Zapata’s impairment is confirmed, Derek Holt’s family may be able to pursue a wrongful death lawsuit against Noah Zapata, holding him accountable for his actions.
My sincerest condolences are with the family of Derek Holt during this challenging time.
