Breann Hailey Mayberry Killed in Hit-and-Run Truck Crash on Highway 395

UMATILLA, OR (December 4, 2025) — A deadly hit-and-run truck crash on Highway 395 near Umatilla resulted in the death of a woman on Monday, December 1. Oregon State Police identified the victim as 31-year-old Breann Hailey Mayberry of Umatilla.

Accident Details: Oregon State Police reported that Mayberry was found dead on the northbound shoulder of Highway 395. Investigators said evidence at the scene suggested that a white commercial motor vehicle was involved and had fled before troopers arrived.

Troopers later noticed a white Freightliner commercial vehicle and trailer being towed. The damage to the truck matched the scene evidence, leading to the seizure of the vehicle, OSP said. A Yakima man was later arrested on a charge of failing to perform duties as a driver.

The highway was closed for about five hours during the investigation.

Investigation: Oregon State Police are investigating the fatal truck accident. The commercial truck driver was arrested for failing to perform duties as a driver after evidence linked his Freightliner to the crash scene.

Legal Considerations: Commercial vehicle crashes where the truck driver flees the scene carry severe criminal and civil consequences. Oregon law requires all drivers, particularly commercial truck drivers, to stop immediately after a collision, render aid, and report the crash. Fleeing after striking a pedestrian demonstrates callous disregard for human life.

Commercial truck drivers are held to higher standards than ordinary motorists due to their specialized training and the dangerous nature of operating large vehicles. When a truck driver strikes a pedestrian on the highway shoulder and flees, they violate both their professional duties and basic human decency.

The fact that investigators matched damage on the towed Freightliner to scene evidence shows the thoroughness of the investigation and the driver’s failed attempt to escape responsibility. Modern investigative techniques make it increasingly difficult for hit-and-run drivers to avoid detection.

Mayberry’s family faces not only the loss of their loved one but also the knowledge that the truck driver chose to flee rather than help her. Wrongful death claims in commercial truck accidents typically involve both the truck driver and the trucking company employing them.

These claims seek compensation for funeral expenses, Mayberry’s pain and suffering before death, lost income and support, and the devastating loss of companionship.

The truck driver’s arrest on criminal charges provides evidence of fault that strengthens civil claims. Companies that employ drivers who commit hit-and-run truck crashes face liability for negligent hiring or supervision if they knew or should have known about the driver’s dangerous tendencies.

Our deepest sympathies to the family and friends of Breann Hailey Mayberry as they grieve this tragic loss.
