Bicyclist Scott Andrew Morris Dies After Collision in Irvine

Irvine, CA (August 1, 2024) – A tragic incident has claimed the life of 61-year-old bicyclist Scott Andrew Morris weeks after he was struck by a vehicle in Irvine.

Accident Details and Ongoing Investigation: The collision occurred on August 1 in the afternoon. Morris was riding his beach cruiser north on MacArthur Boulevard in the number one right turn lane of the I-405 on-ramp. He reportedly made a sudden left turn into the adjacent lane, colliding with a Chevrolet Suburban. The impact caused his bicycle’s handlebar to strike the Suburban’s front door and mirror. Morris was then thrown from his bike and landed on the road.

He was immediately transported to a nearby hospital where he remained under medical care until his passing on Thursday, August 22, 2024. Morris was not wearing a helmet at the time of the collision. The driver of the Suburban remained at the scene and fully cooperated with the ongoing police investigation.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Understanding why Morris made a sudden left turn is crucial. Several possibilities need to be considered, such as whether his bicycle may have malfunctioned or if there was a defect in the road that caused him to swerve unexpectedly. If a mechanical failure occurred, the manufacturer of the bicycle could potentially be held liable for producing a faulty product. Similarly, if a road defect, such as a pothole or uneven pavement, contributed to the accident, the municipality responsible for maintaining the roadway could also bear some responsibility.

Wrongful Death Claim: Depending on the outcome of the investigation, Morris’s family may have grounds to pursue a wrongful death claim. Wrongful death claims seek to hold parties accountable when their actions or inaction result in the death of another person. In this case, if it’s determined that the driver, the bike manufacturer, or the municipality’s negligence played a role in Morris’s death, his family could be entitled to compensation for their loss.

Comparative Negligence: Another important consideration is the role of comparative negligence in this case. While other parties may bear some liability, Morris’s decision not to wear a helmet could be considered negligent. This negligence might reduce any potential compensation awarded to Morris’s family if it’s determined that his failure to wear a helmet contributed to the severity of his injuries.

My deepest condolences go out to the family and loved ones of Scott Andrew Morris during this incredibly difficult time. I hope that the ongoing investigation provides them with the answers they need.
