Merced County, CA (September 27, 2024) – On Friday, September 27, 2024, a tragic head-on collision claimed the lives of two drivers on Highway 152 just east of Arroyo Avenue.
Accident Details and Ongoing Investigation: According to the California Highway Patrol (CHP), a 64-year-old man driving a Ford F150 was traveling eastbound in the westbound lanes for five to six miles before the fatal crash occurred. The driver first sideswiped a vehicle near Box Car Road before crashing head-on with a Honda Pilot driven by 37-year-old Marcy Robison, a resource specialist at Bud Rank Elementary in Clovis.
Upon impact, the Ford F150 burst into flames, and both drivers tragically died at the scene. The Merced County Coroner’s Office has yet to identify the driver of the Ford F150. Authorities are still investigating the cause of the crash, and it is not yet known whether drugs or alcohol played a role.
Legal Considerations: As a personal injury attorney, I find that multiple factors must be carefully examined to determine liability. Here are the critical areas of investigation:
Actions of the Wrong-Way Driver: The Ford F150 driver traveled in the wrong direction for several miles before the crash. Driving against traffic on a busy highway creates a highly dangerous situation, often leading to catastrophic outcomes. An investigation will need to determine why this driver was going the wrong way—whether due to confusion, impairment, or another reason.
Road Conditions: The design of Highway 152 may also be scrutinized. The CHP noted that this stretch of the highway is prone to accidents due to cross traffic and a center median that can make it more challenging to avoid oncoming vehicles. If an investigation reveals that inadequate signage or poor road design contributed to the crash, the government entities responsible for maintaining safe roads may be liable.
Role of Alcohol or Drugs: Although the CHP has not yet determined if alcohol or drugs played a role in the crash, this will be a crucial area of focus in the investigation. Driving under the influence puts other drivers and pedestrians at risk and is generally deemed negligent behavior. If toxicology reports reveal impairment, this could further strengthen negligence claims against the wrong-way driver.
Wrongful Death Claim: Marcy Robison’s family may have grounds to file a wrongful death lawsuit if it is determined that negligence was the cause of the crash. This type of lawsuit seeks to hold the at-fault party accountable for the death and to provide compensation to surviving family members.
Community Response: Robison’s death has deeply affected her community. Bud Rank Elementary’s principal issued a statement expressing heartbreak and support for Robison’s family, students, and staff, noting that psychologists would be available to help them cope with the loss.
My deepest condolences go out to Marcy Robison’s family, as well as her friends, colleagues, and students. I hope they find the strength and support needed to cope with this devastating loss. I also extend our sympathies to the loved ones of the Ford F150 driver.
