Tragic Two-Car Collision in Riverside County Kills Kimberly Higgins and Injures Two Others

Riverside County, CA (June 23, 2024) – A devastating two-car collision on Sunday afternoon resulted in the death of Kimberly Higgins, 51, of Hemet, and left two other individuals hospitalized in serious condition.

Accident Details: The accident occurred at around 1:40 p.m. near the intersection of Simpson Road and California Avenue. California Highway Patrol investigators have determined that the Chevrolet Cruze was traveling westbound on Simpson Road through the intersection when it was broadsided by a Jeep driven by a 17-year-old. Tragically, Kimberly Higgins, who was a front-seat passenger in a Chevrolet Cruze, succumbed to her injuries about five hours after being airlifted to the hospital. The other two occupants of the Cruze, a 53-year-old Hemet man and a 13-year-old girl, sustained significant injuries but were reported to be in stable condition as of Monday. The Jeep driver sustained minor injuries and did not require hospitalization. 

Investigation: Preliminary findings suggest that the teenager failed to stop or yield before entering the intersection. Authorities have stated that alcohol or drugs are not suspected to have played a role in the crash.

Legal Considerations: As a personal injury lawyer, I find that several factors warrant further examination. Under California law, drivers are required to obey traffic signals and signs, and a failure to do so may constitute negligence. The teenage driver’s failure to stop or yield at the intersection indicates a potential breach of this duty. Another essential aspect of the investigation is determining whether a mechanical failure prevented the Jeep from stopping. If the vehicle had brake issues or any other mechanical defect that made it impossible to stop, this could shift liability to vehicle manufacturers or maintenance providers.
