San Jose, CA (November 4, 2024) – On Monday, November 6, Leroy Thomas, 32, of Gilroy, was tragically killed in an alleged intentional hit-and-run near North Capitol Avenue and Berryessa Road in San Jose.
Accident Details: Police responded to the scene around 5 a.m., where they found Thomas unconscious and pinned beneath a minivan. Despite rescue efforts, he succumbed to his injuries. Authorities later identified and arrested Edward Herrera, a San Jose resident believed to have intentionally struck Thomas. Herrera now faces murder charges.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. In addition to criminal charges, the intentional nature of this incident opens the possibility for a wrongful death claim on behalf of Thomas’s family. These claims provide a pathway for families of victims to seek justice for losses resulting from another’s intentional or negligent act. If Thomas’s family pursues such a case, they could potentially seek compensation to address emotional suffering, funeral expenses, and loss of financial support due to this devastating act.
Thomas, remembered by his family as a generous man, leaves behind two children. I offer my condolences to the family and friends of Leroy Thomas during this challenging time.
