Fremont, CA (October 28, 2024) – A heartbreaking accident claimed the life of 3-year-old Nivisha Yathaluru in Fremont, California, on the morning of October 28, 2024.
Accident Details: The accident occurred around 11:45 a.m. at an apartment complex in the 4900 block of Dunsmuir Common near Colleen Terrace. According to Fremont Police, a driver was pulling out of a parking stall. Without warning, the toddler moved into the vehicle’s path. The front left side of the car struck Nivisha. The driver stopped and cooperated fully with the investigation. Emergency responders performed life-saving measures, but the young girl tragically succumbed to her injuries at the scene.
Investigation: Alcohol and drugs were not believed to have played a role in the collision. While the child’s connection to the apartment complex and how she came into proximity to the vehicle remains unclear, investigators continue to look into the circumstances of the crash.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Investigators will explain whether the driver, the property owner, or other parties took adequate precautions. Investigators will likely examine several factors, including the visibility and condition of the parking area, measures in place to prevent pedestrian-vehicle accidents, and the driver’s actions at the time of the collision.
The grieving family may have the option to pursue a wrongful death claim if negligence is found to have been the cause of the accident. With this claim, Nivisha’s family may be able to recover costs, such as funeral costs, emotional suffering, and other damages.
I offer my sincerest condolences to Nivisha’s family and loved ones during this unimaginable time.
