Tragic Collision in Long Beach Claims the Life of Nicholas Kusmich

Long Beach, CA (August 7, 2024) – On Wednesday, August 7, 2024, at approximately 4:45 p.m., a devastating accident involving a mini motorcycle and a Kenworth big rig occurred in Long Beach. The crash took place near the intersection of W. Anaheim Street and Hayes Avenue, resulting in the tragic death of 50-year-old Nicholas Kusmich, a local resident.

Accident Details: Kusmich was riding westbound on his mini motorcycle along the north curb of Anaheim Street. He then collided with the passenger side of the big rig traveling eastbound before making a left turn onto Hayes Avenue. The impact was severe, and Kusmich was pronounced dead at the scene.

Investigation: Speeding and driving under the influence are not suspected to have contributed to the crash. However, authorities are investigating distracted driving as a factor. Anyone with information is urged to contact the Long Beach Police Department.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Determining liability involves assessing fault, which may include evaluating driver actions, adherence to traffic laws, and the condition of both vehicles. The investigation into distracted driving and other potential factors will play a significant role in establishing who may be responsible.

Distracted driving involves examining whether the truck driver used a cell phone or engaged in other distractions that could have compromised their attention. Evidence such as phone records, eyewitness accounts, and in-cab technology can be reviewed to determine if distraction played a role.

Depending on the findings, a wrongful death claim may be pursued by Kusmich’s family. This legal action seeks compensation for losing a loved one due to another party’s negligence.

My sincerest condolences go to Nicholas Kusmich’s family and friends during this difficult time.
