Tragic Collision Claims Three Lives in Kern County

Kern County, CA (October 14, 2024) – On October 14, 2024, a devastating crash at the intersection of Elmo Highway and Scofield Avenue took the lives of three individuals traveling in a Toyota Camry.

Accident Details: A preliminary CHP investigation indicates that a 36-year-old man from Porterville was driving a 2016 Ram 3500 eastbound on Elmo Highway toward a stop sign at Scofield Avenue. His speed is unknown. At the same time, a 1993 Toyota Camry was traveling northbound on Scofield Avenue through an uncontrolled intersection. The vehicles collided. The Camry’s driver and two passengers were pronounced dead at the scene. One of the deceased, identified by the Kern County Coroner’s Office, was 62-year-old Filamer Barayuga Simpliciano of Delano.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Authorities will likely conduct a thorough investigation into the speeds, visibility, and right-of-way rules governing the area to determine whether any party involved was responsible for the collision. Here are key areas that may warrant further investigation:

  • Intersection Control and Right-of-Way: Since Scofield Avenue was uncontrolled in the direction the Camry was traveling, it could be crucial to examine whether either vehicle attempted to stop or yield. Most importantly, did the Ram stop at the stop sign.
  • Speed of Both Vehicles: Establishing speed is vital in understanding whether one or both drivers might have been driving at excessive speeds, which could contribute to liability.

Wrongful Death Possibility: Simpliciano’s family, along with the families of the other victims, may be able to pursue a wrongful death claim if investigators find the Ram driver negligent. California law allows for wrongful death claims when an accident results from another party’s recklessness or failure to yield, providing families with potential relief for their loss.

Comparative Negligence: Under California’s comparative negligence rules, both drivers’ actions will be examined. Even if the Camry driver contributed to the crash, their family could still recover damages based on the other driver’s level of responsibility.

I extend my deepest sympathies to the families and friends affected by this tragic loss. As the investigation unfolds, I hope they find the answers and support needed during this difficult time.
