Tragic Collision Claims the Life of Santa Clara University Student Kephas Pope

Santa Clara, CA (November 21, 2024) – On Thursday, November 21, 2024, an 18-year-old Santa Clara University student, Kephas Pope, tragically lost his life after being struck by a vehicle near El Camino Real and Accolti Way, just outside the university campus.

Accident Details: Pope was riding his bicycle to class when the collision occurred. Emergency responders transported him to a hospital, where he later succumbed to his injuries. The driver involved stopped at the scene and cooperated with law enforcement. Police do not suspect impairment.

Kephas, a sophomore at Santa Clara University majoring in neuroscience and biochemistry, was known for his academic excellence and enthusiasm for working in the organic chemistry lab.

Legal Considerations: As a personal injury attorney, I find that the death of Kephas Pope raises important legal considerations regarding pedestrian and cyclist safety. While details about the circumstances of the crash remain limited, investigations into the following factors could provide clarity:

  • Driver Behavior: Investigators will determine whether the driver was distracted or negligent. The law prioritizes safety for vulnerable road users such as cyclists. Even in cases where a cyclist’s actions might be reviewed, drivers are expected to exercise a heightened duty of care to avoid harm.
  • Visibility and Road Conditions: The accident location near a busy campus might warrant a review of visibility, crosswalk markings, and signage for drivers and cyclists. If infrastructure issues contributed to the crash, there could be grounds for a premises liability claim against the responsible entities.

Possibility of a Wrongful Death Claim: If evidence shows that negligence contributed to this tragedy, Kephas’s family could pursue a wrongful death claim. Potential compensation could address funeral costs, emotional pain, and loss of companionship.

Santa Clara University is honoring Kephas’s memory with a campus vigil following Thanksgiving break, providing an opportunity for the community to come together in mourning and remembrance. I offer my sincerest condolences to Pope’s family and everyone grieving this tragic loss.
