Newark, CA (September 19, 2024) – A tragic accident occurred on Cherry Street in Newark, California, on the morning of Thursday, September 19, 2024, when a 60-year-old bicyclist, Heriberto Rivera of Tracy, was struck and killed by a driver making a left-hand turn into a driveway.
Accident Details: The collision occurred around 8:30 a.m. in the 38000 block of Cherry Street. Rivera was riding south in the bicycle lane on Cherry Street. A northbound vehicle on Chery Street struck Rivera when the driver attempted to turn left into a driveway. Newark police and Alameda County Fire crews responded to the scene, but despite their efforts, Rivera was pronounced dead at the scene.
The driver remained at the scene and cooperated with law enforcement. No arrests were made at the time of the incident. Anyone with information is encouraged to contact law enforcement.
Legal Considerations: As a personal injury attorney, I find that a detailed investigation is necessary to determine who can be held liable. One key aspect that investigators will likely focus on is whether the driver exercised due care before making the left turn. Was the driver distracted? Was the driver speeding? Was the turn made safely? Additionally, they will assess whether any other factors, such as vehicle malfunction or road defects, could have contributed to the accident.
If negligence is found, Rivera’s family may have grounds to pursue a wrongful death lawsuit. Such a claim could seek compensation for the loss of financial support, funeral expenses, and emotional distress damages.
I extend my heartfelt condolences to the family and friends of Heriberto Rivera during this difficult time.
