San Jose, CA (August 10, 2024) – The family of Emily Hamilton, an 18-year-old Morgan Hill woman, is grappling with the aftermath of a tragic accident that claimed her life over the weekend.
Accident Details: According to the California Highway Patrol (CHP), the fatal incident occurred around 11:40 p.m. in the southbound lanes of Highway 101, south of Hellyer Avenue. Hamilton was driving home when she was rear-ended. After pulling over to exchange information with the driver, Hamilton was struck and killed by a second vehicle. The second driver, a 43-year-old Morgan Hill woman, only sustained minor injuries. She has been arrested on suspicion of causing injury when driving under the influence (DUI).
Legal Considerations: As a personal injury attorney, I find that critical aspects need a thorough investigation to determine liability and ensure justice for the victim. Driving under the influence is a breach of traffic laws and is considered negligent behavior. Under California law, DUI cases often result in severe penalties, including fines, license suspension, and potential imprisonment.
This criminal behavior also plays a critical role in civil wrongful death lawsuits, where the focus is on compensating the victim’s family for their loss. Hamilton’s family must prove that Hill’s actions directly caused the fatal accident that killed their loved one.
I offer my sincerest condolences to the family and friends of Emily Hamilton during this heartbreaking and challenging time. Her family has established a GoFundMe account to help pay for burial expenses. Please contribute if you can.
