Richard Evans Killed in San Jose Hit-and-Run While Traveling in Wheelchair; Another Injured

San Jose, CA (May 16, 2025) — A 72-year-old man identified as Richard Evans was killed in a hit-and-run collision early Friday morning near South Almaden Avenue and West Virginia Street in San Jose. The driver, who fled the scene and parked at a nearby residence, was later arrested and is now facing charges related to DUI, vehicular manslaughter, and felony hit-and-run.

Incident Details: The crash occurred around 2:45 a.m. as Evans and his housemate, Julia Aguilera, went to a friend’s house. Evans was using a motorized wheelchair and was traveling alongside parked cars on the roadway, a route reportedly chosen because the sidewalk was uneven and difficult for him to navigate. A speeding vehicle struck them from behind as they moved down the street. Aguilera was grazed by the vehicle and later taken to the hospital for treatment, while Evans was transported to the ICU in critical condition and later died from his injuries.

Eyewitness accounts indicate that the collision was forceful enough to launch Evans from his wheelchair, which was found across the street. The driver reportedly circled the block and parked at his home, where San Jose police later arrested him.

Investigation and Legal Considerations: The driver has been booked into the Santa Clara County Main Jail and is facing serious felony charges, including vehicular manslaughter, DUI, and leaving the scene of a fatal accident. Authorities will investigate whether intoxication and excessive speed were direct causes of the crash, and whether the driver made any attempt to brake or avoid the pedestrians.

Pending the outcome of the investigation, Mr. Evans’ surviving loved ones may be eligible to file a wrongful death lawsuit to recover compensation for medical bills, funeral expenses, emotional trauma, and loss of companionship. Julia Aguilera, who was also injured, may have grounds for a separate personal injury claim related to the crash and its aftermath.
