Placer County DUI Crash Claims Life of Isabel Vasquez

Isabel Vasquez, CA (October 29, 2024) – In a tragic early morning crash on October 29, 2024, Isabel Vasquez, a 24-year-old third-year UC Davis student, was fatally injured when the vehicle she was a passenger in overturned multiple times off Highway 65, north of Nelson Lane in Placer County.

Accident Details: According to the California Highway Patrol, the driver, 26-year-old William Bryan Cubias-Martinez of Marysville, was under the influence of alcohol at the time. Isabel was ejected from the vehicle, as she was not properly restrained by a seatbelt, and died from her injuries. Cubias-Martinez, who sustained major injuries, was arrested on felony charges, including gross vehicular manslaughter, after being released from the hospital. He is scheduled to appear in court on November 7.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination.

DUI and Gross Vehicular Manslaughter: The felony charge of gross vehicular manslaughter implies that Cubias-Martinez’s alleged impaired driving created a high risk of serious harm or death. Investigators will examine the driver’s blood alcohol content (BAC), behavior before the crash, and history of impaired driving, all of which may impact both sentencing and liability.

Passenger Restraint and Liability: California law mandates that drivers ensure passengers wear seatbelts, though the unrestrained status of a passenger, like Isabel, doesn’t absolve the driver of responsibility. The defense may argue contributory negligence due to lack of seatbelt use. However, California’s comparative fault rule still allows victims or their families to pursue damages, as the fault is divided based on each party’s responsibility.

Wrongful Death Claims: In cases of DUI-related fatalities, California law allows families to file a wrongful death claim. The Vasquez family may pursue civil action against Cubias-Martinez to seek compensation for the emotional and financial toll resulting from her death. Such claims often cover funeral expenses, loss of companionship, and emotional distress.

I extend my deepest sympathies to Vasquez’s loved ones, who have lost a beloved daughter, sister, and friend in this tragic incident. Isabel’s kindness, dedication, and dream to serve animals are remembered by all who knew her.
