Pedestrian Rose Dattoli Fatally Struck in Hemet

Hemet, CA (November 10, 2024) – On Sunday, November 10, 2024, Rose Dattoli, 36, of Hemet, tragically lost her life in a pedestrian accident on Stetson Avenue near California Avenue, in the vicinity of the Santiago Palm Vista Mobile Home Park.

Accident Details: According to the Hemet Police Department, the incident occurred shortly after 6:30 p.m. Dattoli stepped into the roadway for unknown reasons in an area lacking marked crosswalks or traffic signals. She was struck by a passing vehicle. The driver immediately stopped to assist and contacted emergency services. Hemet Fire Department paramedics arrived promptly but pronounced Dattoli deceased at the scene.

Investigation: The driver, whose name has not been disclosed, cooperated with investigators and was not arrested. Police have indicated that reckless driving is not suspected in this incident. The Hemet Police Department’s Traffic Bureau is continuing to investigate the circumstances of this tragic accident. They have urged anyone with additional information to contact them.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination.

  • Driver’s Duty of Care: Drivers must exercise caution and maintain awareness, even in areas without crosswalks or traffic signals. Although authorities do not believe the driver was recklessly driving, they should investigate whether the driver did everything a reasonable person would do in a similar situation to avoid the crash.
  • Roadway Conditions and Public Safety: The absence of a crosswalk or traffic control devices where Dattoli attempted to cross could be a contributing factor. If so, Hemet local authorities or other responsible entities may face scrutiny.

Liability and Compensation: If negligence is found, Datotoli’s family may be able to file a wrongful death claim and recover compensation for funeral expenses, loss of financial support, and emotional distress.

Pedestrian Rights and Responsibilities: While pedestrians have the right to traverse public roads, California law also requires them to use marked crosswalks or designated crossing areas when available. In cases where a pedestrian crosses an unmarked area, the investigation may focus on whether the pedestrian’s actions contributed to the accident. If so, the recoverable compensation may be reduced based on California’s comparative negligence laws.

I extend my deepest condolences to Rose Dattoli’s family and friends during this incredibly difficult time. I hope they find the support they need to cope with this loss.
