El Cajon, CA (December 8, 2024) – Richard Michael Santana, 63, was fatally struck by a white 2005 Dodge Ram while crossing the roadway outside a crosswalk at 1368 E. Main Street.
Accident Details: The incident occurred around 5:14 p.m. The truck, traveling westbound, fled the scene. Authorities tracked the vehicle and its registered owner using the city’s Flock license plate reader system. The driver, a 64-year-old man, later met with officers at 1435 E. Main Street and was arrested for felony hit-and-run. Santana’s death was classified as accidental by the San Diego County Medical Examiner.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. The driver’s failure to stop and render aid following the collision constitutes a felony hit-and-run, a serious offense under California law. Drivers involved in accidents have a legal duty to remain at the scene, report the incident, and assist injured parties. Fleeing the scene compounds the tragedy and may be considered negligent.
If Santana’s family can establish that the driver acted negligently by failing to exercise due care while operating the vehicle, they may have grounds for a wrongful death claim. Factors such as the driver’s speed, awareness of the pedestrian, and adherence to traffic laws will be central to determining liability.
I extend my deepest sympathies to Richard Michael Santana’s family and loved ones during this difficult time.
