Pedestrian Ricardo Hernandez Killed in Goleta Crash

Goleta, CA (December 24, 2024) – On the evening of December 24, 2023, a tragic collision in Goleta claimed the life of 76-year-old Ricardo Hernandez, and another was injured.

Accident Details: The incident occurred around 7:02 p.m. at the intersection of Hollister Avenue and Magnolia Drive in Old Town Goleta. According to the Santa Barbara County Sheriff’s Office, Hernandez and another pedestrian were crossing the street in an area without a marked crosswalk when a westbound vehicle traveling approximately 25 miles per hour struck them. The driver reportedly did not see the pedestrians but remained at the scene and cooperated with authorities.

First responders provided emergency medical aid to Hernandez, who was unconscious upon their arrival. He was transported to a local hospital but tragically succumbed to his injuries later that evening. The condition of the second pedestrian has not been disclosed.

Authorities do not believe alcohol or drugs were factors in the collision, and no arrests have been made at this time.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination.

  • Driver Visibility and Responsibility: Investigators will likely examine whether the driver exercised due care while approaching the intersection. Factors like lighting, weather conditions, and potential distractions could influence liability.
  • Roadway Conditions
Authorities may also investigate whether roadway defects, inadequate lighting, or missing signage contributed to the collision. The victims’ families could pursue claims against the responsible public entity if municipal negligence is identified.

Ricardo Hernandez’s family may have grounds to file a wrongful death claim if negligence was the cause of the crash. The surviving pedestrian may pursue a personal injury claim against the driver. Even if the pedestrians were partially at fault for crossing outside a crosswalk, California’s comparative negligence laws could allow the victims’ families to recover some damages. Compensation would be reduced based on their share of responsibility.

My deepest condolences go out to Ricardo Hernandez’s family and friends as they cope with this heartbreaking event. I also wish for a full recovery for the injured pedestrian.
