Pedestrian Michael Stoecker Killed in San Diego Crash

San Diego, CA (September 11, 2024) – A tragic accident on September 11, 2024, claimed the life of 35-year-old Michael Stoecker when a Volkswagen sedan fatally struck him.

Accident Details: The collision happened shortly before 12:30 a.m., according to the San Diego County Medical Examiner’s Office. Stoecker was walking on Interstate 5, just south of Old Town Avenue in San Diego. He died at the scene of the accident.

Legal Considerations: As a personal injury attorney, I find it essential to conduct a thorough investigation to determine what led to the fatal collision and whether any parties can be held liable. Several factors may need closer scrutiny:

  • Condition of the Roadway: Why was Stoecker walking on the freeway? Investigators may need to explore whether hazardous conditions forced him onto the road. Was there adequate signage or barriers to prevent pedestrian access to the highway? Poor visibility at night could also have contributed to this tragic event.
  • Driver’s Actions: The driver’s behavior must also be examined. Was the driver following the speed limit? Were they distracted or impaired? Even though pedestrians aren’t expected on freeways, drivers still must operate their vehicles safely.
  • Vehicle Maintenance: Another line of inquiry is whether the Volkswagen sedan was adequately maintained. Issues like malfunctioning headlights or worn-out brakes could have impacted the driver’s ability to avoid the collision.

Michael Stoecker’s family may have the option to pursue a wrongful death lawsuit, depending on the findings of the investigation. Under this claim, they may be able to recover funeral expenses, loss of financial support, and emotional distress damages.

I extend my sincerest condolences to Michael Stoecker’s family and loved ones. My thoughts are with them during this difficult time.
